By purchasing, subscribing to, downloading, installing, or using NoahArk369 (MT4/MT5 Expert Advisor), you (“the Client”) agree to the following Terms & Conditions. If you do not agree, do not purchase or use the product.

1) Product Scope & License

• NoahArk369 is a software product (Expert Advisor) provided under a subscription/license model.

• Your access is granted only for the active subscription period you purchased.

• The license is personal and non-transferable unless we provide written approval.

2) Client Eligibility & Minimum Requirements

To support stable execution and best results, the Client confirms they meet these minimum requirements:

• Broker: ECN / RAW / Low spread with fast execution

• Account Type: Hedging-enabled account

• Leverage: 1:400 or higher

• VPS: Mandatory (24/7 operation)

• Minimum Deposit: $2,000 recommended
  If your setup differs, performance and behavior can change materially and you accept that responsibility.

3) Setup, Presets, and Client Responsibility

• We may provide presets and setup guidance as support; however, the Client is responsible for applying settings correctly.

• The Client must select one risk profile with no exceptions:
  Simple (small drawdown) / Medium (moderate drawdown) / Aggressive (deep drawdown).

• The Client accepts the drawdown level and exposure behavior that comes with their selected profile.

4) Strict Risk & Responsibility Disclaimer (Forex/CFDs & NoahArk369)

Forex and CFD trading involves significant risk and may not be suitable for all investors. You may lose some or all of your invested capital. Past performance—including backtests, Strategy Tester reports, and historical results—is not a guarantee of future performance. No trading system, including NoahArk369, can promise profits, prevent losses, or eliminate risk.

NoahArk369 is a software tool that supports rules-based execution only; it is not financial advice, investment advice, or a managed account service. All trading decisions, risk settings, and account management remain solely the Client’s responsibility. Testing on a demo account and applying proper risk controls (lot size, leverage, stop settings, and exposure limits) are strongly recommended.

Backtest and Strategy Tester results depend on data quality and assumptions, and can differ materially from live trading due to broker execution, spreads, slippage, latency, liquidity, and market conditions. While we use high-quality historical data and aim for the best possible accuracy, historical data may not be 100% precise and live conditions can vary significantly.

By purchasing or using NoahArk369, you confirm you understand and accept these risks and take full responsibility for all trading outcomes without exception.

5) Updates, Maintenance, and Compatibility

• We may release updates to improve stability, performance, or security.

• The Client is responsible for installing updates properly, following provided instructions.

• Platform, broker, and market changes may affect performance; compatibility is supported within reasonable limits.

6) Support Policy

• Support is provided according to your plan (trial, 3 months, 6 months, 12 months).

• Support covers installation guidance, preset application, and basic troubleshooting.

• Support does not include financial advice, trade recommendations, or account management.

7) Prohibited Use

The Client agrees not to:

• Copy, resell, share, distribute, reverse-engineer, or modify NoahArk369 without written permission.

• Provide the software to third parties or use it beyond the agreed license terms.

Violation may result in immediate termination of access without refund.

8) Payments, Renewals, and Refunds

• Subscription fees are payable in advance for the selected period.

• Renewals may be offered; the Client is responsible for managing their subscription timeline.

• Refund policy: Digital software access and delivered license services are typically non-refundable once activated, unless required by applicable law or explicitly stated otherwise.

9) Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any direct or indirect losses, including trading losses, missed profits, execution issues, or third-party broker problems.

• The Client assumes full responsibility for platform/broker conditions, VPS stability, and all trading outcomes.

10) Acceptance

By completing payment and/or using NoahArk369, the Client confirms they have read, understood, and accepted these Terms & Conditions and the Strict Risk & Responsibility Disclaimer.

NoahArk369 Subscription Process Agreement
